"WIN AN ARCHIE ROSE SUMMER GIN ADVENTURE" TERMS AND CONDITIONS

The Promoter's Details

  1. The promoter is Distillery Est Pty Limited ACN 164 606 035 acting in its capacity as trustee for the Distillery Operation Trust ABN 14 396 500 693 trading as Archie Rose Distilling Co. of 61 Mentmore Avenue, Rosebery in the State of New South Wales (Promoter).

Conditions of Entry

  1. The entry to the "Archie Rose Win A Summer Gin Adventure" (the Competition) is free and open to residents of Australia over the age of 18 years (Eligible Person).
  2. The following persons are not eligible to participate in the Competition:
    (a) all directors, officers, management, employees and other staff of the Promoter or any venue associated with the promotion and the related bodies corporate of the Promoter or any venue associated with the promotion; and
    (b) the immediate family members of directors, officers, management, employees and other staff of the Promoter or any venue associated with the promotion or the related bodies corporate of the Promoter or any venue associated with the promotion (including spouses, children, parents, brothers and sisters).
  3. Participation in the Competition is deemed acceptance of these terms and conditions.
  4. The Promoter may withdraw the Competition at any time, or amend these terms and conditions in its sole and absolute discretion without any further notice to an Eligible Person or an entrant.

How to Enter

  1. To enter the Competition, Eligible Persons must between 9.00 am (AEST) on Monday, 15 October 2018 and 11.59 pm (AEST) on Sunday 25 November 2018 (Competition Period):
    (a) visit https://archierosecomp.com.au/ (Archie Rose Promotional Website) and:
    (i) choose a preferred Prize; and
    (ii) provide the personal details of the relevant Eligible Person; and
    (iii) upload a photo in response to the following question:
    "What image best describes your favourite Bush or Coast location in Australia?".
  2. Each Eligible Person may only submit a maximum of two (2) entries in the Competition by submitting:
    (a) a maximum of one (1) entry for a Bush Prize; and
    (b) a maximum of one (1) entry for a Coast Prize.
  3. The Promoter does not guarantee the availability of any one or more of the Prizes. The provision of any Prize is subject to availability and the terms and conditions of any third party providers (as the case may be).
  4. The provision of any Prize is subject to the sole discretion of the Promoter. The Promoter has no obligation to provide any Prize to any person, entrant or Eligible Person whatsoever.

Details of Prizes

  1. There will be a maximum of ten (10) winners of the Competition.

  2. Each winner of the Competition will receive one (1) of the following prizes (Prizes and each a Prize):

    (a) Unyoked, NSW (a Bush Prize):
    (i) two (2) nights twin share accommodation at Unyoked, NSW (valued at Recommended Retail Price (RRP) $398); (ii) two (2) 700 millilitre bottles of Archie Rose Summer Gin Project: Bush and Coast (valued at RRP $198 (Archie Rose Summer Gin);

    (d) Bellwether, SA (a Bush Prize):

    (f) Captains Rest, TAS (a Coast Prize):

  3. Each of the Prizes do not include provision for:
    (a) any flights, transportation or transfers; or
    (b) any travel insurance.

  4. Each of the Prizes are non-transferable, non-refundable and non-redeemable for cash.

  5. Each Prize can only be used once by the winner of that Prize.

  6. In respect of the accommodation included in each of the Prizes set out in clause 11 above (Accommodation), the relevant winner of each Prize must book that Accommodation directly with the relevant venue and use the Accommodation during the available time periods as set out in the table below (subject to room availability and the terms and conditions of each respective venue):

Saffire Freycinet, TAS (see clause 11(g) including dates between 1st March 2019 to 30th September 2019, excluding long weekends, public holidays and subject to availability.

The Little Black Shack, NSW (see clause 11(h) including dates between 26th November 2018 to 30th November 2019, excluding NSW school or public holidays and subject to availability.

The Pole House, VIC (see clause 11(i) including dates between 26th November 2018 to 11th October 2019, excluding peak seasons (Dec 23rd – Jan 28th ) Easter, long weekends and subject to availability.

Bannisters, NSW (see clause 11(j) from Sun - Thurs only between the dates of March 1st 2019 to 30th June 2019, excluding NSW school or public holidays and subject to availability.

Duration of the Competition

  1. The Competition will operate for the Competition Period.

Determination of winner

  1. The winner of the Competition will be determined by Friday, 7 December 2018.
  2. The winners of the Competition will be determined by Archie Rose Head of Marketing, Victoria Tulloch, according to the merits and creativity of the photos submitted in the Competition. This decision will be final and cannot be appealed.

Notification of Winner

  1. The winners of the Competition will be notified by email by 5 pm (AEST) on Friday, 7 December 2018.
  2. The names of the winners of the Competition will be posted on the Archie Rose Promotional Page by 5 pm (AEST) from Monday 10 December 2018.
  3. The details of the Prize will be emailed to the address of the winners as nominated in the entry of the winner in the Competition.

Prize Redemption

  1. In order to redeem a Prize:
    (a) the winner must:
    (i) contact the Promoter at the following email address info@archierose.com.au; and
    (ii) provide the Promoter with the nominated Australian address of the winner in order for the Promoter to deliver the Archie Rose Summer Gin in a single shipment to the winner, by 5pm AEST on 18 December 2018; and
    (b) the Promoter must confirm by email to the winner:
    (i) that the winner has successfully redeemed their Prize; and
    (ii) the details of the Prize of the winner.
  2. Once the winner has redeemed their Prize from the Promoter, the winner can then contact the relevant Accommodation venue directly to make a booking before the applicable Relevant Period expires (see clause 15 above).
  3. If the winner does not, for any reason:
    (a) book their Accommodation with the relevant venue before the applicable Relevant Period expires (see clause 15 above);
    (b) use their booked Accommodation; or
    (c) provide the Promoter with a valid nominated Australian address for the Promoter to deliver the Archie Rose Summer Gin to the winner;
    the winner will forfeit the Prize and the winner will not be able to use or claim the Prize.

Perpetual Licence

  1. By entering into this Competition, each Eligible Person grants to the Promoter an irrevocable, exclusive, transferrable, royalty-free and perpetual licence (with a right to sub-licence) (Licence) to use and publish in any medium and in any way whatsoever (including for commercialisation) all materials submitted by that Eligible Person to the Promoter as part of the Competition, including any photos (Materials).

Warranties and Representations

  1. By entering into this Competition, each Eligible Person represents and warrants to the Promoter that:
    (a) the Eligible Person owns all intellectual property rights in the Materials or otherwise has a right to use and sub-licence the use of the Materials, including to the Promoter;
    (b) the Eligible Person has full legal right, power and authority to:
    (i) grant the rights and privileges granted by that Eligible Person to the Promoter under these terms and conditions; and
    (ii) perform all of the obligations of that winner under these terms and conditions.

Indemnity

  1. By entering into this Competition, each Eligible Person:
    (a) unconditionally and irrevocably indemnifies the Promoter against any liability, loss, cost or expense incurred or suffered by the Promoter, caused or contributed to by any breach (actual or anticipated) of these terms and conditions; and
    (b) will defend, at its own expense, any action against the Promoter brought by a third party to the extent that the action is based upon a claim that the Materials submitted by that Eligible Person infringes the intellectual property rights or any other rights of a third party;
    (c) will defend any such claim at its sole cost and expense and pay those costs and damages finally awarded against the Promoter in any such action that are attributable to such claim or those costs and damages agreed to be paid in any monetary settlement of such action.

Disqualification

  1. The Promoter reserves the right to verify, reject and/or disqualify any entries into the Competition (including after the winner has been determined and notified), including in circumstances where:
    (a) the Promoter considers an entry to be offensive, defamatory, objectionable, inappropriate or otherwise infringe the rights of any third party; or
    (b) an Eligible Person does not have the full legal right, power and authority to grant the Licence to the Promoter in accordance with clause 25 above;
    (c) an Eligible Person or a winner is unable or refuses to take part in any part of the Competition; or
    (d) the entry does not comply with any of these terms and conditions; or
    (e) the entry is submitted by any person who tampers with or benefits from any tampering with the entry process, the operation of the Competition or who acts in breach of these terms and conditions or who annoys, abuses, threatens or harasses any other person.

No Liability

  1. To the extent permitted by law, the Promoter is not responsible or liable for:
    (a) inaccurate or incorrect transcription of entry information;
    (b) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, or entered other than as directed in the entry instructions;
    (c) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software; (d) unauthorised human intervention in any part of this Competition;
    (e) electronic or human error which may occur in the administration of this Competition;
    (f) any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a winner and, where applicable, to any family or other persons accompanying a winner; or
    (g) any injury or damage to persons or property, including to the computer of the participant or any other person related to, or resulting from, participation or downloading any materials in this Competition.
  2. The Promoter and the related bodies corporate of the Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from negligence) in connection with this Competition or acceptance or use of the Prize except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

Unclaimed Prize Draw

  1. If a Prize is not redeemed by a winner on or before 4 January 2019, the relevant entry of the winner entry will be deemed invalid and the Promoter will determine another winner in accordance with clause 18 by 5pm (AEST) on 11 January 2019 at the offices of the Promoter and the relevant winner will be notified by telephone and email.

Privacy

  1. The Promoter is bound by the Privacy Act 1988 (Cth) (Privacy Act). The privacy policy of the Promoter explains how the Promoter manages and protects personal information of individual entrants and forms part of these terms and conditions.
  2. The Promoter will handle any personal information that the Promoter collects about an entrant in accordance with the Privacy Act (below) and our privacy policy.

Competition Activities

  1. Entrants (including all Eligible Persons) must, at the request of the Promoter, participate in all promotional activity (such as publicity and photography) surrounding the Competition or the winning of a Prize, free of charge, and they consent to the Promoter and the related bodies corporate of the Promoter using their name and image in promotional material. Without limitation, all entrants (including all Eligible Persons) consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this Competition or in taking or using any Prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time.

Permit

  1. The conduct of the Competition does not require a permit.

We will take all necessary measures to fulfil this commitment, including to:
    (a) comply with the Australian Privacy Principles (APPs);
    (b) ensure that we manage your personal information openly and transparently;
    (c) only collect personal information from you that we need in order to fulfil any of your requests or to offer you the best possible customer service and experience or to process entries and contact winners for the purpose of any competitions or events hosted by Archie Rose.
    (d) tell you how we might use your personal information;
    (e) let you know if we need to disclose your personal information to anyone else (including anyone overseas) and if so, in what circumstances this might occur;
    (f) keep your personal information secure;
    (g) respond promptly and appropriately to any incident where your personal information may be compromised, including where your personal information is lost, or subject to unauthorised access, modification, use or disclosure or other misuse;
    (h) promptly respond to any request by you not to receive direct marketing material from us;
    (i) make sure your personal information is kept accurate and up to date and to properly dispose of any personal information which is no longer required by us; and
    (j) ensure that, where appropriate, you can access and correct your personal information.

  1. This policy is intended to explain clearly and in plain language some of the key processes and procedures that we have implemented to manage your personal information, to protect your privacy and to comply with the Privacy Act 1988 (Act) and the APPs.
  2. References to "Archie Rose", "our", "us" and "we" in this policy are references to Archie Rose and its related entities.

This policy gives a broad overview of our policies in relation to privacy and the handling of your personal information but if you require further information, you are welcome to contact us or to read any of the privacy statements or notices that will be issued to you as and when personal information is collected.
  4. You must read this privacy policy before providing us with any personal information. By providing us with your personal information, you are confirming your agreement to the policies and procedures described in this privacy policy.

    What sorts of personal information do we collect?

  5. We will only collect from you information that is necessary and relevant to our relationship with you, including to enable us to fulfil your request or to provide to you the best possible customer service and experience or to process entries and contact winners for the purpose of any competitions or events hosted by Archie Rose.
  6. Depending on the exact nature of our relationship with you and the type of goods and services you request from us, we may request that you provide some or all of the following information: (a) information that we may require to initially identify you, including your full name (or the name of your business), age and job title;
    (b) information that we can use to process your purchase of any goods or services provided by Archie Rose, including your credit card number, name on the credit card, credit card expiry date and credit card security code;
    (c) information that we can use to deliver any goods or services provided by Archie Rose, including your personal address, work or business address and mailing or shipping address;
    (d) information that we can use to contact you, including your telephone number, mobile number and email address; and
    (e) information that we may require for the purposes of any competition or event hosted by Archie Rose, including any material, written responses, photos and data associated with your entry for any competition or events hosted by Archie Rose.
  7. The information we require from you will depend on the specific goods or services that we are providing to you. We will only collect personal information from you that we reasonably require in order to fulfil your request or satisfactorily provide goods or services that you require from us or to process entries and contact winners for the purpose of any competitions or events hosted by Archie Rose.
  8. The Act places restrictions on us collecting sensitive information about you (which includes information about your religion, political views, ethnicity, criminal records and sexual preferences).
    Generally we will not collect this type of information, however we may need to collect some sensitive information if you are applying for a job with us, and you have provided us with your consent to do so.

Why do we require your personal information?

  1. There are various reasons why we might need to collect, hold, use or disclose your personal information and this will depend upon the specific goods or services that we are providing to you but we will tell you the main reason for asking for your personal information at the time when we ask you to provide it.
  2. Usually, the main reason that we will need to collect your personal information will be relating to a good or service that we are providing to you or are about to provide to you and for contacting you in relation to those goods or services. Our main reason for collecting your personal information will revolve around the processing of any of your orders, including the purchase of any Archie Rose products or tickets for any Archie Rose distillery tours or experiences or classes.
  3. We may also use your personal information for other reasons, including:
    (a) to contact you in relation to an event, special offer, product or service that you might be interested in;
    (b) to email a copy of the latest Archie's Journal or any other Archie Rose newsletters, notifications or marketing material;
    (c) to process, determine and contact any winners in relation to any competitions or events hosted by Archie Rose;
    (d) preventing fraud and other criminal activities;
    (e) to assist us to run our business and to improve our products, services and performance, including staff training, accounting and auditing, risk management, record keeping, archiving, systems development, developing new products and services and undertaking planning, research and statistical analysis and data analytics; and
    (f) to comply with our legal obligations.
  4. There is no obligation for you to provide us with any of your personal information but if you choose not to provide us with your personal information, we may not be able to satisfy any requests or to provide the information, goods or services that you require or to contact you if you are a winner of any competitions or events hosted by Archie Rose.

How do we collect your personal information?

  1. The means by which we collect your personal information will depend on the nature of the goods or services that we are providing to you.
  2. We may collect your personal information:
    (a) directly from you, either in person, via email or website or any other social media platforms or over the phone;
    (b) when you complete a form on our website:
    (i) to process any of your orders for any Archie Rose products or tickets for any Archie Rose distillery tours or experiences or classes; or
    (ii) to receive Archie's Journal, or any other Archie Rose newsletters, notifications or marketing material; or
    (iii) any competitions or events hosted by Archie Rose
    (c) from publicly available sources, for example, the electoral role, the telephone directory or from third party websites.
  3. We will always collect your personal information directly from you unless it is impracticable to do so.
    Collecting and disclosing personal information about others
  4. Wherever possible, we will collect personal information directly from the relevant individual to whom that information relates.
  5. You represent and warrant to us that where you provide personal information to us about another person:
    (a) you are authorised to provide that information to us;
    (b) you have obtained the express consent of the individual to disclose their personal information to us for the use of that personal information by us, including for the purposes outlined in this policy;
    (c) you have complied with the Privacy Act, including the APPs in collecting that personal information, including by making all relevant notifications required under APP 5 and specific to our use of the personal information; and
    (d) you have informed that person about the contents of this privacy policy including who we are, how we use and disclose personal information, and that they can gain access to, and correct, that information.

Unsolicited personal information

  1. From time to time we may receive personal information about you that we have not requested or taken steps to come to know. In these circumstances, we will only hold on to such information as permitted by the Act. Any information that has not been requested but is subsequently retained by us will be subject to the procedures and requirements set out in this privacy policy.

How do we use or disclose your personal information?

  1. We may use and disclose your personal information for the purposes for which it was collected or for a related purpose such as:
    (a) to consider your request for a product or service;
    (b) to enable us to provide a product or a service to you;
    (c) to carry out, or respond to, your requests;
    (d) to process, determine and contact any winners in relation to any competitions or events hosted by Archie Rose;
    (e) to our third party service providers, including to assist us in providing, and improving, our services to you, and to analyse market trends and better understand your needs or to develop, improve and market our products and services to you;
    (f) for regulatory reporting and compliance with our legal obligations;
    (g) to relevant third parties to undertake fraud checks;
    (h) to various regulatory bodies and law enforcement officials and agencies to protect against fraud and for related security purposes;
    (i) to perform administrative and operational tasks (including risk management, systems development and testing, staff training and collecting debts);
    (j) to use in direct marketing of promotions, products and services that we, or our third party service providers, think may be of interest to you;
    (k) to seek your feedback in relation to particular products or services, customer satisfaction and our relationship with you and to manage any customer complaints;
    (l) to companies or entities related to Archie Rose for any of the purposes referred to in this policy;
    (m) to monitor or improve the quality and standard of goods and services that we provide to you;
    (n) to consider any concerns or complaints you may raise against us;
    (o) to our agents, successors and/or assigns;
    (p) to notify you of offers that may be of interest to you; and
    (q) to better understand your preferences.
  2. By agreeing to accept the terms of this privacy policy or by providing your personal information to us, or both, you are taken to have consented to the use and disclosure of your personal information for the above purposes.
  3. At the time that we collect your personal information, we will make it clear to you why we are collecting your information, including through this privacy policy where appropriate. We will only use your personal information in accordance with, and as permitted by, the Act.
  4. Other than as outlined in this privacy policy or in any notice provided to you at the time of collecting your personal information, we will not disclose your personal information without your consent unless disclosure is permitted by the Act.

Do we share your personal information with others?

  1. We may provide your personal information to third parties as outlined in this privacy policy.
  2. We may share your personal information with other companies that are related to Archie Rose. By agreeing to accept the terms of this privacy policy or by providing your personal information to us, or both, you consent to your personal information being shared with our related entities.
  3. We deal with third party service providers who may assist us with a variety of functions including with research and marketing, mail and delivery, security, insurance, professional advisory (including legal, accounting and auditing advice), banking, payment processing, fraud checks or technology services. By agreeing to accept the terms of this privacy policy or by providing your personal information to us, or both, you are taken to have consented to us disclosing your personal information to our third party service providers. Where we engage third party service providers to perform services for us, those third parties may be required to handle or deal with your personal information. Under these circumstances, those third parties must safeguard this information and must only use it for the purposes for which it was supplied and we will make all reasonable enquiries to try to ensure that this is the case.
  4. Wherever possible, we will limit the information provided to independent third parties to that information required for those third parties to properly perform their functions.

  5. As part of the goods or services that we provide to you, we may:
    (a) use personal information that we have collected about you to identify a product or service that may benefit you;
    (b) contact you from time to time to let you know about a product or service or event that we believe you might be interested in; and
    (c) disclose your personal information to any third parties or to any entities or companies related to Archie Rose to enable them to tell you about a product or service that you might be interested in.
  6. Where we intend to use your personal information for direct marketing purposes, we will seek your consent to do so prior to using your personal information. Any such requests will be actioned within a reasonable period of time and there will be no charges to you for making, or to you from us actioning, such requests.

  1. We take breaches of your privacy very seriously. In the event that there is a data breach relating to personal information that we hold about you, such as loss of, unauthorised access to, or unauthorised disclosure of, the information (Data Breach), we will take immediate steps to contain and remedy any effects of the Data Breach in accordance with our Data Breach Response Plan. Where required under the Act, we will notify both you and the Office of the Australian Information Commissioner (OAIC) of the Data Breach.

Maintaining your personal information

  1. We take reasonable steps to ensure that:
    (a) the information that we collect about you is accurate, complete and up-to-date at the time of collection;
    (b) when we use your personal information, it is accurate, up-to-date, complete and accurate at the time of use; and
    (c) if we disclose your personal information, it is accurate, up-to-date, complete and accurate at the time of disclosure.
  2. You warrant that all information that you provide to us is accurate, complete and up to date at the relevant time.

Will we disclose your personal information to anyone overseas?

  1. There may be circumstances where we need to disclose your personal information to a third party overseas (Overseas Recipient). This may occur, for example, where we have a database or server hosted outside Australia.
  2.   1. There are some limited circumstances in which we may not be able to provide you with access to your personal information when requested. Such circumstances might include where access would pose a serious threat to the life, health or safety of another person or where such access would unreasonably impact on the privacy of others.
  2. Where you request access to your personal information, we will respond to any such request in accordance with the Act.
  3. We may recover from you our reasonable costs of supplying you with access to your personal information but we will not charge you for any request you might make to access your information.

  1. We do what we can to ensure that the information we hold about you is accurate, complete, up-to-date, relevant and not misleading. To assist us to do this, it is imperative that you provide us with correct information at the time you provide it to us and immediately inform us if any of the information changes at any time.   1. We are committed to maintaining and protecting your privacy but it is possible that in limited circumstances, mistakes might be made. Our main reason for collecting your personal information will revolve around the processing of any of your orders, including the purchase of any Archie Rose products or tickets for any Archie Rose distillery tours or experiences or classes or to provide to you the best possible customer service and experience or to process entries and contact winners for the purpose of any competitions or events hosted by Archie Rose.

    (a) to contact you in relation to an event, special offer, product or service that you might be interested in;
    (b) to email a copy of the latest Archie's Journal or any other Archie Rose newsletters, notifications or marketing material;
